The legal status of the childcare arrangement determines everything else: social security contributions, civil liability and how absences are handled. Before comparing the nanny profiles available in Dijon, families need to choose between direct employment, an agency mandate and a service contract—three arrangements with very different implications.

Service provider, agency mandate or direct employment: the status that changes everything in Dijon

The shortcut “use an agency so you don’t become an employer” deserves a closer look. Two models coexist among childcare agencies, including those operating in the Dijon metropolitan area.

With a service provider, the agency employs the caregiver and bills the family for the service. The parent has no relationship of subordination with the nanny: there is no employment contract to draw up, no payslip to issue and no Urssaf declaration to file. The agency assumes all employer obligations.

Under an agency mandate, the agency recruits the caregiver and handles payroll and administrative formalities on the family’s behalf. The parent remains the legal employer. They sign the employment contract, are responsible for any dismissal and owe the social security contributions. The agency simplifies the administration; it does not take over the employer’s responsibilities.

To find a reliable nanny in Dijon without taking on the role of employer, families must explicitly request a service contract and check that the payslip is issued in the agency’s name, not the parent’s.

Matching platforms, such as classified ad sites and social networks, do not resolve this issue. A parent who hires someone through an ad and pays the babysitter directly becomes the de facto employer, even without a written contract.

CMG and tax credit: what families in Dijon really pay for in-home childcare

The childcare allowance (CMG) was reformed on September 1, 2025. The amount is now calculated based on household income, the number of childcare hours and family circumstances, replacing the previous flat-rate scale.

An often-overlooked technical point: the CMG works differently depending on the arrangement. With direct employment or an agency mandate, the CAF pays the benefit to the parent-employer. With a service provider, the agency’s invoice is used as the basis for the calculation, subject to different caps and rules.

Advertised rate and actual out-of-pocket cost

An hourly rate shown in an ad or agency quote says nothing about the net cost. If the rate exceeds the hourly cap used to calculate the CMG, the family pays the difference in full. We recommend requesting a personalized estimate before making any commitment.

The tax credit for in-home employment can cover half of eligible expenses, up to an annual cap. Keep two things in mind:

  • The tax credit is paid after a delay. Families have to cover the costs upfront for several months, which can strain tighter budgets.
  • Eligible expenses vary depending on whether childcare is provided under a service contract or through direct employment. The amount that can be declared is not the same.
  • The CMG and tax credit can be combined, but the tax credit applies to the amount remaining after the CMG has been deducted, not to the gross expense.

How to assess an in-home nanny’s reliability: look beyond your gut feeling

Platforms in Dijon list several hundred babysitter profiles. A large pool does not guarantee thorough screening. Here are the practical checks that distinguish a sound hiring decision from a gamble.

  • Criminal record check (bulletin n°3): reputable service providers routinely request one. With direct employment, it is up to the parent to do this, which rarely happens.
  • A qualification or certification related to early childhood care (CAP AEPE, bac ASSP or childminder approval). A profile describing someone as a “dynamic student” is no substitute for training in pediatric first aid.
  • Verifiable references from previous families. A service provider agency will normally check these as part of its recruitment process.
  • Professional liability insurance. With a service provider, the agency’s insurance covers any damage. With direct employment, the parent must check their home insurance and whether it includes an “in-home childcare” clause.

Recruiting through Facebook groups or classified ad sites in Dijon gives families access to a large pool of candidates, but the platform does not carry out any checks. All screening is left to the parent.

Ongoing support and cover for absences

One often-underestimated factor is how unexpected situations are handled. If the nanny falls ill on a Monday morning, a family employing them directly is left without childcare. A service provider agency with a pool of trained caregivers may be able to arrange cover, sometimes within a few hours. This practical advantage justifies part of the price difference between direct employment and a service contract.

Occasional or regular childcare in Dijon: choose an arrangement that fits your needs

Occasional babysitting on a Saturday night and after-school care four days a week do not fall under the same arrangement. For occasional childcare, using a pre-funded CESU simplifies payment without requiring a complex contract. The family remains the employer, but the paperwork is reduced.

For regular in-home childcare, a service provider is the only arrangement that completely removes the family’s employer status. The contract is with the agency, not the caregiver. If the nanny leaves the agency, the agency handles the replacement and ensures continuity of service.

Monthly costs are higher with a service provider than with direct employment because the agency’s margin covers recruitment, training, replacement cover and HR administration. The meaningful comparison is not the gross hourly rate, but the net cost after benefits, weighed against the time parents save by not managing payroll, leave and potential disputes.

In Dijon, families looking to combine regular weekday childcare with occasional weekend babysitting should check whether an agency offers both options under a single service contract, rather than having to deal with multiple providers and arrangements.
